These terms apply to your use of ashton-care.com.au (the "site"), operated by BCO Group LLC, a Delaware (USA) limited liability company trading as Ashton Care ("we", "us"). By using the site you agree to them. Nothing in these terms limits rights you have under the Australian Consumer Law.

1. Buying our products

You can buy Ashton Care products on Amazon Australia and, where we offer it, directly on this site.

Purchases made on Amazon are governed by Amazon's Conditions of Use and its returns policies, together with your rights under the Australian Consumer Law. Amazon's price and delivery charges shown at its checkout are the ones that apply to an Amazon order.

Purchases made directly on this site or in our app are governed by our Terms of Sale, Shipping Policy and Returns and Refunds policy. Our app is covered by the App Terms of Use.

2. Prices

Prices on this site are in Australian dollars and are the total price you pay, including any taxes that apply. The regular price of a pouch is the same as the price we set on Amazon. If a price on this site is shown in error, we will contact you and you can choose to cancel for a full refund.

3. Ratings

The star rating and number of ratings shown on this site are Amazon's overall customer rating for our Amazon listing, covering all ratings, positive and negative. We update them manually; hover over or tap the rating to see the date they were last updated. Every link to them goes to Amazon, where you can read all current ratings and reviews. We do not write, select, edit or pay for reviews.

4. Product information

We take care to describe our products accurately. Images on this site may be illustrations, and colours can vary slightly between screens. Always read the label and our safe use guide before use.

5. Not medical advice or a medical device

Ashton Care mouth tape and nasal strips are personal care products. They are not medical devices or therapeutic goods and are not intended to diagnose, prevent, treat or cure any condition, including snoring or sleep apnoea. Information on this site is general in nature and is not medical advice. If you have a health condition or concern, speak to a doctor or pharmacist before use.

6. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. See our returns and consumer guarantees page for details. If any part of these terms would exclude, restrict or modify a right or remedy you have under the Australian Consumer Law or another law that cannot be excluded, that part does not apply to that extent.

ASHTON CARE is a registered trade mark in Australia. The site's text, design, graphics and images are owned by or licensed to us and are protected by copyright. You may view and share pages for personal, non-commercial purposes, but you may not copy, reproduce or use our trade marks or content for any other purpose without our written permission.

Amazon and all related marks are trademarks of Amazon.com, Inc. or its affiliates. Their use on this site does not imply endorsement by Amazon.

8. Using the site

The QR codes on our packs link to pages on this site. Where those pages change over time (for example when our app becomes available), the QR code will take you to the current version.

If you have a complaint, contact us and we aim to respond within 2 business days. If we can't resolve it, you can contact NSW Fair Trading or the consumer protection agency in your state or territory, or the ACCC.

These terms are governed by the laws of New South Wales, Australia. You may bring proceedings in the courts of New South Wales or any other Australian court with jurisdiction.
