Quiet Nights: Terms of Use

Please read this before using Quiet Nights and Ashton Care products. It explains what the app is, what it is not, and the rights you always keep.

Not medical advice

Quiet Nights is a general wellness and habit app. It is not a medical device and it does not diagnose, treat, cure or prevent any disease, including snoring or sleep apnoea.

The sleep score, findings and tips are based only on what you enter. They are not medical measurements. Nothing in the app, its articles, news summaries or community replaces advice from your doctor, pharmacist or sleep specialist.

Use mouth tape safely

Do not use mouth tape if you cannot breathe easily through your nose, have a cold, blocked nose or allergies flaring, have diagnosed or suspected sleep apnoea, asthma, COPD or another breathing or heart condition, feel nauseous or may vomit, have had alcohol, sleeping pills or sedatives, or are pregnant, unless your doctor says it is fine for you. Not for children under 18.

Remove the tape at once if you feel short of breath, anxious or uncomfortable. Stop using it and see your doctor if your skin is irritated. Test a small piece on your skin first.

Loud snoring with gasping or pauses in breathing, waking unrefreshed, daytime sleepiness or morning headaches can be signs of sleep apnoea. Please see your GP. In an emergency call 000.

Your rights under Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.

Using the app at your own risk

You choose how and when to use the app and our products, and you are responsible for following the safety guidance above. To the extent permitted by law, we are not liable for loss arising from relying on general information in the app, from posts by other members, or from using our products against the safety guidance. Any limitation of our liability applies only to the extent permitted by law and does not affect your rights under the Australian Consumer Law.

Rewards, games and leaderboards

The promoter of all app competitions is Becato LLC, the publisher of Quiet Nights. Prizes are supplied by BCO Group LLC, owner of the Ashton Care brand. Each competition runs for one calendar month in Sydney time and the leaderboard shows when it ends.

Prizes are decided only by skill and effort, with no element of chance: routine prizes by routine points, game prizes by the highest game level reached and then the best score on that level. Every player gets the same falling pattern on the same day. If players tie, the player who reached that score or total first ranks higher.

A month's prizes are only awarded if at least 20 players took part in that leaderboard. Game prizes go only to players who reached the final level (level 5). Routine gift cards need at least 300 routine points. If these minimums are not met, that prize is not awarded for the month. Playing in the app is free. Prizes are only for Ashton Care customers: to win a prize you must have bought an Ashton Care product on Amazon.com.au. To receive a prize you must also be an Australian resident aged 18 or over, hold one account only, and give us the order number for that purchase, which we check against our order records before a prize is sent. Staff of the promoter and their families cannot win. Prizes are not transferable and cannot be exchanged for cash; if a prize becomes unavailable we will give one of equal or greater value.

We may disqualify entries that use cheating, automation, multiple accounts or anything that breaks these terms. A Quiet Nights Plus subscription never gives any advantage in a competition. Winners are contacted in the app and by email and must reply within 14 days. Apple, Google and Amazon are not sponsors of, and are not involved in any way with, these competitions.

Snorers Club rules

We have zero tolerance for abusive members or objectionable content. Be kind. No medical advice, links, selling, personal details, or claims about named people, doctors or brands. You are responsible for what you post and you allow us to show it in the app. You can delete your own posts at any time.

Use Report on any post or reply. We review reports within 24 hours and remove content or accounts that break these rules. If you believe a post is defamatory or raises another legal issue, report it as a legal complaint or email [email protected], and we will act within 7 days.

Purchases and subscriptions

Ashton Care products are sold and delivered by Amazon.com.au under Amazon's terms. If you subscribe to Quiet Nights Plus, payment is taken by the App Store or Google Play, the subscription renews automatically unless you cancel at least 24 hours before the end of the period, and you can manage or cancel it in your store account settings.

Trademarks and other services

Ashton Care is a registered trade mark of BCO Group LLC. Amazon, Apple Watch, Pixel Watch, Samsung, Fitbit and Garmin are trade marks of their owners and are used only to describe compatibility or where to buy. Links to news sites and other services are for information: we do not control them and they belong to their owners.

Privacy

Quiet Nights is published by Becato LLC (USA). Your nights, check-ins and scores stay on your phone. Our server, run on Cloudflare with data stored outside Australia including in the United States, keeps only your name, email, optional phone, nickname, kit, routine points, game scores and club posts. Some of this can be health information, so we only collect it with your consent and use it to run the app, competitions and, if you opt in, Ashton Care emails from BCO Group LLC.

We never sell your data or use health information for advertising. You can access or correct your details, or delete your account at any time in You. Our full privacy policy explains how to complain and how we handle data breaches.

Questions or complaints: [email protected]. If we change these terms we will show the new date here and tell you in the app before a significant change takes effect; if you do not agree you can stop using the app and cancel any subscription.

If you live in Australia, these terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales and of the State or Territory where you live.
